2008 Cruisin' For A Cure Grand Prize Car Official Contest Rules
These official rules govern the conduct of the raffle. By purchasing a raffle ticket, you agree to be bound by these official rules stated herein and the decisions of Cruisin' for a Cure (CFAC). The Grand Prize Car winner will be drawn at random on Saturday, September 27, 2008, at the Orange County Fairgrounds in Costa Mesa, CA. Winner need not be present to win. The winner will be required to sign and return an affidavit of eligibility and liability/publicity release within fourteen (14) days of notification or prize will be deemed forfeited. The deadline to enter is September 27, 2008, by 4:30 PM. A maximum of 7,500 tickets will be sold. If fewer tickets are sold, the odds of winning the Grand Prize increases. The IRS has taken the position that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not gifts, and consequently do not qualify as deductible charitable contributions. Raffle participants and prize winner agree that CFAC will be able to use their name and/or likenesses for media including television, radio, web and print. The prize winner may be published on CFAC's website. Grand Prize is one (1) customized 33 Laid Back ford Roadster, approximate retail value $50,000.00. Proof of current valid driver's license and proof of insurance will be required prior to vehicle delivery. Winner must take delivery of vehicle from Lake Forest, Orange County, CA. Winner shall be responsible for taking delivery of vehicle, "as is", and any and all applicable delivery costs. Winner shall be responsible and liable for all federal and state taxes and responsible for paying directly to CFAC (Cruisin’ For a Cure) the required 28% of the vehicle's fair market value of $50,000 which equals $14,000 in taxes before winner may take delivery of the winning vehicle. An IRS W-2G form will be issued. Winner shall sign and complete IRS Form W-2G at time of delivery of vehicle and pay the 28% ($14,000 to CFAC) or will result in forfeiture of prize, 1933 Laidback Ford Roadster by Legends Motorsports. CFAC will be responsible for issuing the W-2G form and reporting to the IRS by February 28, 2009 money paid by winner. If winner is a non-resident of California, then an additional 7% ($3,500) will be collected and due to CFAC and remitted with Form 592-A. Title, license, registration, insurance, and all other fees associated with prize (street rod vehicle) will be responsibility of winner. There is no option of converting the vehicle into a cash prize in lieu of the vehicle. No prize transfers or substitutions. By entering, participants agree to release sponsor and its agents from any and all liability, loss, damage, or injury resulting from participation in this opportunity drawing, receipt, possession, use and/or misuse of any prize awarded herein and sponsor shall not be responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law. Winner shall be responsible for all applicable taxes on the prize: subject to federal, state and local laws and regulations. Winner is strongly advised to consult professional legal and tax advisers prior to ticket purchase. Collected taxes from Grand Prize Winner will be remitted to the IRS and Franchise Tax Board for the credit of the Grand Prize Winner. There is no guarantee the IRS, Franchise Tax Board or any other party will accept the estimated value of the vehicle in determining the amount of income tax that will be due from the Grand Prize Winner or for any other purpose. Advertising images used by CFAC are subject to modification and enhancement and are not representations or warranties of any kind. Award of prize could have adverse effects on the Grand Prize winner, including, without limitation, with respect to taxes, income, government entitlements and benefits, or legal, financial or other matters. Prize Winner shall indemnify, defend and hold harmless Cruisin' For A Cure's Board of Directors and Officers, UCLA Jonsson Cancer Center Foundation, Legends Motorsports/Downs Design, and their directors, officers, employees and agents from and against all actions, causes of action, liabilities, losses, claims, suits, judgments, liens, awards and damages of any kind and nature whatsoever for property damage, consequential damages, personal injury or death (including without limitation injury to or death of Prize Winner or any family members) and expenses, costs of litigation and counsel fees related thereto or incident to establishing the right to indemnification, arising out of or in any way related to acceptance of this Prize.
If the Grand Prize winner cannot be located after reasonable attempts to do so by CFAC, or if any winner is deemed to be ineligible or does not otherwise claim his or her prize by 5:00 p.m. on the day that is 14 calendar days following the Grand Prize Drawing, such winner will be deemed to have forfeited his or her prize. Winner's name may be obtained by writing to CFAC. Requests must be received in the 14 day period following the Grand Prize Drawing. Eligibility: Open to all legal residents of the fifty (50) United States and District of Columbia who are 18 years of age or older at the time of entry and who possess a current, valid driver's license. All raffle ticket sales are final. Tickets may not be changed, sold or transferred by the purchasing party or anyone else. CFAC assumes no responsibility for lost or non-delivered tickets prior to the drawing deadline. No refunds will be made under any circumstances, except as may be determined in Cruisin' for A Cure's Board of Directors and Officers sole and absolute discretion. By purchasing a ticket, each purchaser represents and warrants to Cruisin' For A Cure's Board of Directors and Officers, UCLA Jonsson Cancer Center Foundation, and Legends Motorsports/Downs Design that he or she has read and understands these Rules and agrees to be bound by these Rules and the decisions of the Cruisin' for A Cure Board of Directors, UCLA Jonsson Cancer Center, and/or Legends Motorsports/Downs Design, shall be final.
